Terms of sale

 

1. Seller Identification

These Terms and Conditions of Sale govern all sales of physical products made on the website Aliens Are Everywhere, operated by Ata Kademli – Sole Proprietorship (Entreprise Individuelle), under the registered trade name Ka e-Commerce.
By placing an order on the Website, the Customer fully and unconditionally accepts these Terms.

2. Products

The Website offers physical products only.
Product descriptions and images are provided for information purposes only. Images are non-contractual and may show slight variations due to screen display settings or manufacturing differences.


3. Prices

Prices are expressed in Euros (€) and are VAT-exempt pursuant to Article 293B of the French Tax Code.
Shipping costs are displayed before order confirmation.
The applicable price is the one displayed at the time of order confirmation.


4. Promotional Offers and Discount Codes

Discount codes are non-transferable, non-refundable, and non-cumulative unless otherwise stated.
They may be modified or withdrawn by the Seller at any time.


5. Order Process

Order confirmation constitutes full acceptance of these Terms.
The Seller reserves the right to refuse or cancel any order in the event of:

-Payment incident

-Fraud suspicion

-Abnormal order volume

-Dispute relating to a prior order

In case of product unavailability after order confirmation, the Seller may cancel the order and issue a full refund.


6. Payment Methods

Payment is made in Euros (€) via secure online systems.
Accepted payment methods may include:

-Credit / debit cards (Visa, MasterCard via Shopify/Stripe)

-PayPal

-Apple Pay, Google Pay

Payment is required in full before order processing.
Any unjustified chargeback initiated by the Customer may result in suspension of the account and legal recovery of the amounts due.


7. Invoicing

Invoices are issued electronically and sent by email.
Invoices are issued without VAT in accordance with Article 293B of the French Tax Code.


8. Delivery

Delivery conditions are governed by the Shipping Policy, which forms an integral part of these Terms.
Estimated delivery time: 9–13 business days.
Delivery times are indicative and may vary due to circumstances beyond the Seller’s control.


9. Customer Responsibility for Delivery Information

The Customer is solely responsible for the accuracy of the delivery address.
No refund shall be granted for non-delivery resulting solely from incorrect or incomplete information provided by the Customer.
Reshipment costs, where applicable, shall be borne by the Customer.


10. Right of Withdrawal and Returns

The Customer benefits from a 14-day right of withdrawal, under the conditions described in the Return & Refund Policy available on the Website.
Returned products must be unused, complete, and in their original condition.


11. Defective, Damaged, or Incorrect Products

The Customer must contact support within 48 hours of receipt, with photographic evidence.
A replacement will be offered as a priority.
If replacement is impossible, a refund will be issued.
Return shipping costs are covered by the Seller in such cases.


12. Lost Packages

No refund or reshipment shall be issued before official carrier confirmation.
An investigation period of up to 30 business days may apply depending on the carrier.
Upon confirmation of loss:

-A replacement will be offered as a priority

-If unavailable, a full refund will be issued


13. Liability

The Seller shall not be held liable for indirect damages, loss of income, or improper use of the products.
The Seller’s liability is limited to the amount paid for the order.
This limitation of liability does not apply in cases of:

-Gross negligence

-Willful misconduct

-Personal injury

-Mandatory consumer protection rights


14. Force Majeure

Neither party shall be held liable for delays or failures caused by force majeure events such as natural disasters, strikes, pandemics, transport disruptions, or governmental restrictions.


15. Personal Data

Customer personal data is processed in accordance with the Privacy Policy and in compliance with the GDPR.


16. Transfer of Ownership

Ownership of the products is transferred to the Customer only after full payment of the order price has been received by the Seller.


17. Transfer of Risk

The risk of loss or damage to the products is transferred to the Customer at the time of physical delivery of the products.


18. Stock Unavailability

In the event of stock unavailability after order validation, the Seller shall inform the Customer as soon as possible.
The Seller may cancel the order and issue a full refund without liability.


19. EU Online Dispute Resolution (ODR)

In accordance with EU Regulation No. 524/2013, the Customer may use the European Online Dispute Resolution platform available at:
https://ec.europa.eu/consumers/odr


20. Contract Language

These Terms are drafted in English, which shall be the only legally binding version.
Any translated version is provided for convenience only and shall have no legal force.


21. Modification of the Terms

The Seller may modify these Terms at any time.
The applicable version is the one in force at the time of order validation.


22. Applicable Law and Jurisdiction

These Terms are governed by French law.
In the event of a dispute with a consumer, jurisdiction lies with the courts of the consumer’s place of residence within the European Union, in accordance with EU consumer protection regulations.
